Terms of Service of Mystic AIda
These Terms are an agreement between you and Mystic Syndication Network Inc., a Delaware corporation ("Mystic AIda", "we", "us"). They cover the Mystic AIda website, apps and services, which we call the Service.
Please also read our Acceptable Use Policy and our Privacy Policy. Both are part of this agreement.
Acceptance
By creating an account, buying carats, or using any part of the Service, you agree to these Terms. If you do not agree, please do not use the Service.
If you use the Service on behalf of a company or another organization, you confirm you are allowed to accept these Terms for them.
Eligibility
You must be at least 18 years old to use the Service. The Service is not designed for children and we do not knowingly allow anyone under 18 to hold an account. If we learn that an account belongs to someone under 18, we will close it.
You also confirm that you are allowed to use the Service under the laws that apply where you live.
Accounts and Security
You are responsible for what happens on your account. Keep your login details private, use a password you do not reuse elsewhere, and tell us promptly if you think someone else has access.
Give us accurate information when you sign up, and keep it current. One person, one account, unless we agree otherwise in writing. Do not share your account with anyone else or sell it.
The Service and AI-Generated Content
Mystic AIda is a companion platform for tarot, astrology and horoscopes. Creators build AI personas we call Mystics. Members, who we call Seekers, receive readings and reflections from those Mystics.
Every reading, horoscope, chart interpretation, image and message produced by a Mystic is generated by artificial intelligence. It is offered for reflection and entertainment only.
Readings are not medical, legal, financial, or psychological advice, and no Mystic is a licensed professional. Do not use a reading in place of advice from a doctor, therapist, lawyer, accountant, or any other qualified professional. If you are in crisis, please contact a local emergency service or a crisis line.
AI output can be inaccurate, inconsistent, or simply strange. Two readings on the same question may disagree. Treat what you read as a prompt for your own thinking, not as a statement of fact or a prediction of what will happen.
We may change, add, or remove features at any time, including Mystics, spreads, and other parts of the Service.
Carats and Purchases
The Service uses an in-app currency called carats, shown in places as emeralds or the ✦ symbol. Carats unlock readings and other features.
- Carats are a limited licence to use features inside the Service. They are not money, they have no cash value, and they are not a deposit, balance, or stored value account.
- Carats cannot be transferred, sold, traded, or exchanged for cash outside the Service.
- Purchases are final. Carats are non-refundable except where a refund is required by law, or where we choose to give one at our discretion.
- Carats spent on a reading are used when the reading is generated, even if you do not like the result.
- We may change prices, carat costs, and promotional grants at any time. Changes do not apply retroactively to carats you already bought.
- If your account is closed for breaking these Terms, any unused carats are forfeited.
Payments are handled by third party payment processors. Their terms apply to the payment itself. If you bought carats through an app store, that store's refund rules may also apply.
Your Content and the Licence You Give Us
You may add content to the Service: questions, notes, profile details, images, messages, and Mystic personas if you are a creator. We call all of this Your Content. You keep ownership of Your Content.
You give us a worldwide, non-exclusive, royalty free licence to host, store, copy, display, adapt, and distribute Your Content, only as needed to operate, secure, and improve the Service. If you share a reading publicly, or publish a Mystic, that licence extends to showing it to the people you shared it with, or to the public where you chose a public setting.
You promise that Your Content is yours to share, and that it does not break the law or our Acceptable Use Policy.
Readings are generated for you. As between you and us, you may use your readings for your own personal, non-commercial purposes. Similar or identical output may be generated for other people, so no one gets exclusive rights over AI output.
Creators and Mystics
If you publish a Mystic, you take on extra responsibility for it. You are responsible for the persona's name, image, voice, description, and the instructions that shape its readings.
- Do not build a Mystic that imitates a real person, a real business, or a real brand without clear permission.
- Do not present a Mystic as a licensed professional, or let it give medical, legal, financial, or psychological advice.
- Make sure you have the rights to any images, names, or writing you upload for the persona.
- You are responsible for how your Mystic behaves toward Seekers, including keeping it inside our Acceptable Use Policy.
We may review, edit, unpublish, or remove a Mystic at any time, and we may end creator access for anyone who repeatedly breaks these rules.
Care Packages and Messages to People Who Are Not Members
The Service lets you send a reading to another person as a care package, and lets you send messages to other members. A care package arrives by email or in the app. We never text a phone number that someone else typed in. If you want to send a care package by text, you share its link yourself, from your own phone.
- You must have a real relationship with the person you send a care package to, and a good reason to believe they would welcome it. Do not send care packages to strangers, to a list of addresses, or to anyone who has asked you to stop.
- You are responsible for the recipient's email address being correct, and for anything you write in the message.
- A recipient can ignore the email. They are never required to open it, sign up, or reply, and they can ask us to stop sending them anything.
- A care package email may offer a one-tap sign-up. If the recipient uses it, an account is created for them under their own name and contact details, and from that point they are a member under these Terms with their own account and their own privacy choices.
- Sending a care package does not give you any access to the recipient's account, or any right to read what they do on the Service afterward.
Misusing care packages or messages is one of the fastest ways to lose your account. See the Acceptable Use Policy.
Text Messages
Mystic AIda texts only a phone number you add yourself. The program name is Mystic AIda. You may get two kinds of texts:
- Sign-in codes, when you sign in with your phone.
- "Someone left you something" texts, only if you turn them on. They are off until you turn them on.
We never send marketing texts. You do not have to agree to texts to use the Service; you can sign in with email instead.
- Message frequency varies.
- Msg & data rates may apply.
- Reply STOP to cancel at any time.
- Reply HELP for help, or email support@mysticaida.ai.
- Carriers are not liable for delayed or undelivered messages.
You can also turn texts off or remove your number on your account page. See our Privacy Policy for how we handle your number.
Acceptable Use
Your use of the Service is governed by our Acceptable Use Policy, which covers harassment, impersonation, spam, illegal content, attempts to manipulate or extract the AI, and more. Breaking that policy is a breach of these Terms.
Intellectual Property
The Service itself, including the software, designs, artwork, the Mystic AIda name and logo, and the platform Mystics we publish, belongs to us or our licensors. These Terms do not give you any rights in them beyond using the Service as allowed here.
Do not copy, resell, reverse engineer, or create derivative versions of the Service, and do not remove any notices from it.
If you believe something on the Service infringes your copyright, contact us at support@mysticaida.ai with enough detail to identify the work and the material you are reporting.
Suspension and Termination
You can stop using the Service at any time and ask us to close your account.
We may suspend or close an account, remove content, or limit features if we believe there has been abuse, a breach of these Terms or the Acceptable Use Policy, a risk to other members, or a legal requirement. Where it is reasonable to do so, we will tell you why and give you a chance to respond.
When an account ends, your licence to use the Service ends, unused carats are forfeited as described above, and we may delete your content after a reasonable period, subject to our Privacy Policy and any legal obligation to keep records.
Disclaimers
The Service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not promise that the Service will be uninterrupted, error free, or secure against every threat, and we do not promise that any reading will be accurate, useful, or true. You use the Service, and act on what you read, at your own risk.
Limitation of Liability
To the fullest extent allowed by law, Mystic AIda and its owners, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities, arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
Some places do not allow certain limitations, so parts of this section may not apply to you.
Indemnity
You agree to defend and hold harmless Mystic AIda and its owners, employees, and partners from claims, losses, and reasonable legal costs arising from your use of the Service, Your Content, a Mystic you publish, a care package you send, or your breach of these Terms or the Acceptable Use Policy.
Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules.
Please contact us first. Most problems can be settled quickly by email, and we ask that you give us thirty days to resolve a dispute informally before starting a formal claim.
If that does not work, you and we agree that any dispute will be brought in the state or federal courts located in Delaware, and we each consent to the jurisdiction of those courts. You may also bring a qualifying claim in small claims court.
Claims must be brought individually, not as part of a class or representative action.
Changes to These Terms
We may update these Terms as the Service changes. When we do, we will update the effective date at the top of this page. If a change is significant, we will give notice in the app or by email before it takes effect.
Continuing to use the Service after a change means you accept the updated Terms. If you do not accept them, please stop using the Service and close your account.
